Building regularisation

A building permit is the local authority’s approval confirming that the completed building, or part of it, meets the required standards and is suitable for its intended purpose.
On 1 July 2015, the Act on the Implementation of the Act to Implement the Building Code and the Planning Act came into force. With this new legislation, the building register has taken on greater significance. Previously, the data in the building register had only informative and statistical value. However, from 1 April 2016, applications, design conditions, notifications, building and use permits and injunctions recorded in the building register now hold legal authority, similar to that of the land register.
The importance of regulation for property owners:
Fire on the property: the registration of all buildings is necessary in case of a possible fire, so that the Rescue Board can check how many buildings are on or near the property.
Selling real estate: when looking to sell buildings, banks consider the legality of the buildings to be important when granting a loan to the buyer. In the case of a loan, the buyer must typically order a valuation report from a real estate agency. However, if the buildings are not on the building register or the information is incorrect, either the valuation report cannot be issued, or the report is incomplete and does not correspond to reality. Banks often seek clarification as to why a building lacks a building permit and may refuse to grant a favourable loan decision. In practice, the absence of an occupancy permit can pose a serious obstacle to obtaining a loan, potentially leaving the property unsold.
Insurance and compensation for damage: incomplete registration can lead to issues with insuring the building and receiving compensation for accidental damage, as the destruction of the property is not officially recorded, leaving no legal basis for compensation.
